1. Definitions

a. User/Users - Visitors and Registered customers of the web site.
b. USB007- USB007.com hosted website.
c. T & C - This entire Service Agreement
d. Product - Product available in the shopping Cart.

2. Product
USB007 provides direct marketing products from the manufacturer. These products are shipped and serviced directly from our manufacturing partner with a one-year replacement warranty.

3. Payment Process
USB007 employs Worldpay as our processing agent to process payments. All charges will be billed under "TC Shopping Network ". There will be a shipping and handling fee for each product you order which will be non-refundable after the product has been shipped. It will take 1 to 3 days for your payment to be confirmed by USB007 processors. USB007 will not initiate the shipping process until USB007 confirms that your payment has been received.

4. Dispute of Payment
USB007 reserves the right to charge Users $40.00 AUD as a service charge for the purpose of investigative service if USB007 finds the charge-back dispute has no basis.

5. Shipping and Handling
USB007 will prepare to ship product once the payment is confirmed from USB007 processors. USB007 will initiate the shipping process and send the order to one of the USB007 Logistic warehouses Worldwide. Orders received by the warehouse will take between 2 to 5 Business days to process and will be sent to a third party international carrier by the choice of USB007 and delivered to the Users. At the time of delivery, signature and identification will be required Worldwide. Shipment transport time is dependent on the Country and location Users reside. Major countries like USA, Canada, UK, Germany, Japan and China may only take 5 to 10 business days. Other countries may take up to 15 to 20 business days. USB007 reserves the right to refuse any order if USB007 carriers do not service the geographic location. Users are responsible for any and all taxes, import duties, custom charges and all laws and regulations of the country in which Users reside. Users will be charged an extra $20 AUD handling fee for any returned package due to Users error for re-shipping.

6. Cancellations, Refuse and Refund
Cancellations are allowed if our processors did not accept the payment. Once the payment is confirmed accepted by USB007, there will be a cancellation charge to cancel the order. No refund is allowed unless USB007 failed to deliver your product at all and no re-shipment was attempted. No other refunds are accepted. All sales are final. If the User refuses the product, there will not be any refund due to the fact services had been performed and there will be no re-shipment attempt. User account will be cancelled.

7. Returns and Warranty
If an unforeseen Situation happens within 1-year of Users shipment or Users find the product received was defective, we will gladly replace it for the User. All User has to do is contact us at techsupport@usb007.com with a description of the problem. We will assess the situation and issue a RMA number and a return address for user to ship the product back prepaid. Collect shipment and shipment without proper RMA number will be refused. Once USB007 receives and confirms the defect or situation, a replacement product will shipped back prepaid to the User as soon as possible. USB007 does not give warranty to any defective product damaged by incorrect installation, use, modifications or repaired by any unauthorised 3rd party or the User.

9. Change of Terms
USB007 reserves the right to change any or all service terms and to discontinue the product post on website at anytime, with or without notice.

10. Limited Liability
EXCEPT FOR THE WARRANTIES SET, USB007 DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ANY IMPLIED WARRANTIES THAT MAY BE IMPOSED BY APPLICABLE LAW ARE LIMITED TO THE TERMS OF THIS LIMITED WARRANTY. IN NO EVENT SHALL USB007.COM BE LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF BUSINESS, PROFITS, DATA OR USE, WHETHER IN AN ACTION IN CONTRACT OR TORT OR BASED ON A WARRANTY, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE PRODUCT, EVEN IF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU AGREE THAT REPAIR, REPLACEMENT OR REFUND, AS APPLICABLE, UNDER THE WARRANTY SERVICES DESCRIBED HEREIN IS YOUR SOLE AND EXCLUSIVE REMEDY WITH RESPECT TO ANY BREACH OF THE LIMITED WARRANTY SET FORTH HEREIN. IF, DESPITE THE FOREGOING LIMITATIONS, FOR ANY REASON BECOMES LIABLE TO YOU FOR DAMAGES INCURRED BY YOU IN CONNECTION WITH THIS AGREEMENT, THEN, THE LIABILITY OF WILL BE LIMITED TO THE AMOUNT EQUAL TO THE INVOICE AMOUNT PAID BY YOU FOR THE SERVICES.
